    California's 5th District Court of Appeal launched a new online Appellate Self-Help Resource Center for self-represented litigants and lawyers who seek help with the appeals process.


    "The appeals process is daunting and mysterious," said Brian Cotta, clerk/executive officer for the 5th District Court of Appeal. "As a solution and in close partnership with the other courts of appeal in California and the Judicial Council, we've created one, uniform website for self-represented litigants and attorneys."

    “People just don’t know that they need a court reporter. They aren’t going to know to fill out another form. It is hard enough to figure out the forms they have in front of them,” said Madeline Howard, a senior attorney with the Western Center on Law & Poverty. “What will happen is that litigants will not know how to make a request. They will usually not make one and then when they make their way to a legal services office, maybe after having a bad decision of the trial against them, we won’t know whether we can appeal, because we have no record of what happened.”

    It’s rare for a filed pleading to go missing, but it happens. An original verified pleading or declaration in a time-sensitive matter is safely filed with the court, but at the hearing, the judge flips though the file and states, “I know this pleading was filed, and I looked at it yesterday, but I can’t find the original in the file and it’s necessary for me to proceed. I can continue the matter so you can provide a new pleading, or deny without prejudice."

    In 2017, California enacted a law precluding employers from asking about prior salary history and requiring employers to give applicants, on reasonable request, the pay scale for a position. This law raised many questions for employers, including who’s “an applicant,” what’s a “pay scale,” and what constitutes a “reasonable request?” Now we have the clarifications.

    The state’s Assigned Judges Program, which costs the state about $27 million annually, allows trial courts to tap retired judges to fill in for judicial absences, such as when judges take leave for vacation and illness, in order to prevent delays in civil, criminal, family and other proceedings in California’s 58 trial courts.

    The class-action lawsuit focuses on the fees that Apple takes on sales in its App Store, which millions of people use every day to download games, messaging apps and other programs. The company charges up to a 30 percent commission to developers who sell their products through its store, bars them from selling their apps elsewhere and plays a role in setting prices. App makers have long complained that the fee and other practices are unfair.
