Summary
Employees, contractors, and business counterparties increasingly come into direct contact with a business's own computers. These interactions, like any, sometimes result in litigation, but the laws that govern the misuse of computers contain traps for the unwary and unprepared. This program will address contexts where computer misuse laws apply in civil litigation, identify ways to avoid misunderstandings about access, and show you how to make and respond to claims under these laws in litigation.
Topics:
• Federal and California Computer Crime and Misuse Laws
• Computer Fraud and Abuse Act, California Comprehensive Computer Data Access and Fraud Act, Stored Communications Act, Digital Millennium Copyright Act, and more.
• Computer Crimes by Employees and Ex-Employees
• Remedies Available for Companies
• Drafting Agreements that Protect Rights of Access
