Why are some lawyers better at settling cases than others? Why is harder to get certain clients to agree to a reasonable compromise? Understanding how the brain processes conflict is key to managing and resolving disputes. From business formation, real estate and transactional work, to estate planning and probate, to full-fledged litigation, all forms of practice involve conflict resolution. Collaborative Practice is based on an understanding of how conflict negatively impacts an individual’s ability to engage in a rational resolution process and provides concrete tools for diminishing those impacts. Originally developed for family law cases, collaborative practice is now used regularly to address pre-and-post mortem estate disputes and other civil matters. Collaborative tools can help reduce client costs, improve results, and lead to greater client satisfaction.
