Trauma-Informed Lawyering: Representing Clients in Sexual Violence and Sexual Harassment Cases

As attorneys, we represent clients who have experienced trauma and who have mental health conditions, yet most of us do not have formal training regarding trauma or mental health issues.

In this MCLE, we will discuss representing clients in sexual violence and sexual harassment cases from a multidisciplinary perspective, applying information about the effects of trauma on the brain and the mental health effects of sexual abuse to the litigation context. We will cover how to build trust with prospective clients, how to assess clients’ resilience, and how to assess our own ability to effectively represent clients in these cases. We will learn how, from a clinical perspective, litigation, administrative grievance processes, and interaction with the criminal justice system affect sexual violence survivors. Finally, we will discuss effective litigation strategy, including how to deal with delays in reporting, how to prepare clients for depositions, and confidential and non-confidential settlements.
