Evidence Tool Kit Part Two

Please join Alameda County Judges Cramer and Brand along with representatives from the Alameda County District Attorney's Office and Public Defender's Office for a program on the basics of evidence.

Need a practical refresher course on the rules of evidence? Tired of invoking the Sitwell Doctrine (“What’s your objection counsel? “I don’t know, it just doesn’t sit well.”) The Evidence Survival Tool Kit: It’s More Than Just A State Of Mind is a 2-session course taught over 4 hours by four Superior Court judges designed to provide criminal and civil lawyers with a practical overview of the rules of evidence. Through hypotheticals and simulations, participants will develop a better understanding of the rules and their effective application in trial.  

  1. October 18th: The first 2-hour session focuses on notions of relevance (including the use of out of court statements for non-hearsay purposes,) the requirements of competence and personal knowledge, refreshing recollection, and the introduction of writings and documentary evidence (authentication and the best evidence rule.)  
  2. October 25th: The second session zeroes in on hearsay, including difficult exceptions (state of mind, business records, past recollection recorded and the use of prior inconsistent and consistent statements.)

Indeed, evidence is more than just a state of mind! It’s a powerful tool to help you represent your client more effectively.
