“It’s Real and It’s The Law”: Litigating Implicit Bias Cases
Explicit bias is a product of cognizant, intentional, discriminatory behaviors. In contrast, implicit bias refers to the belief that unconscious, unintentional, biases can influence decision-makers that adversely affects members of certain groups. Every person and every employer must ask "where is the unconscious bias in my organization and what is its impact?" Impacts can include favoring one particular group over another for promotions or raises; impacts can include how employees treat certain people in the workplace without really realizing it. But, employees and employers alike must identify the unconscious bias and determine if its impact may be violating the law.
This presentation will highlight litigation strategies addressing implicit bias, ways in which it can be proved/disproved in the courtroom, and ways to prevent implicit bias prior to litigation. This seminar qualifies for the MCLE elimination of bias units.
