Santa Clara County Bar Association
The SCCBA Real Property Section presents an MCLE Brown Bag:
How the DA Office's Real Estate Fraud Unit Prosecutes and Can Clear Title on Forged Instrument Cases
Your client comes to you alleging someone has recorded a forged deed and stolen title to his or her home. You suggest to the client that she or he make a report to the police or sheriff’s department, only to learn they have already done so, but were told it's a civil matter. What now? Learn from the Santa Clara District Attorney’s Real Estate Fraud Unit how to report a real estate fraud crime, how the DA’s office prosecutes allegations of forgery, and new laws which allow the DA’s office to obtain an order voiding a false or forged recorded deed or other instrument in a criminal proceeding. The program will also discuss what the DA’s office is doing to proactively discover potentially forged deeds, and how civil attorneys can help the DA’s office in combating this crime.
