Class litigation is a minefield of potential ethical problems for attorneys seeking to contact potential class members because of rules against contacts with represented parties. This program will cover:
- What contacts are covered by California Rule of Professional Conduct 2-100
- Distinguishing when a subordinate is represented by corporate counsel
- Under what circumstances may an attorney contact a putative class member
- How the stage of the litigation and the timing of class certification may (or may not) affect the ability of counsel to contact a class member
