A dialogue with noted song copyright litigator Richard Busch and local entertainment lawyer David Given will cover the Blurred Lines case (in which Mr. Busch served as counsel to the Marvin Gaye heirs), the pending Ninth Circuit appeal in the Stairway to Heaven case, ongoing infringement litigation against Spotify (in which both Messrs. This is a seminar for every litigator to learn about the importance of thinking about insurance coverage early in a case -- for a plaintiff to make sure they can get paid despite a judgment-proof defendant and for a defendant to make sure someone else foots the bill in case of liability. The federal Superfund law, CERCLA, governs the investigation, cleanup, and liability for polluted sites throughout the United States. As a result, CERCLA is one of the most commonly encountered environmental laws. CERCLA and its governing principles touch on the full range of human endeavors, from shifting liability in multi-million dollar corporate transactions to affecting people right in their own homes.
Accordingly, any attorney interested in or practicing environmental law should have a solid understanding of CERCLA, and when CERCLA considerations might arise. For the attorney not specializing in environmental law, particularly corporate and real estate transaction lawyers, this panel will introduce you to key considerations for deals involving property—even for property that is supposed to be free from pollution.

Negotiating Civil Settlements Under California's Revised Rules of Professional Conduct:
The New Ethics of Resolving Litigated Cases

 

California's revised Rules of Professional Conduct, which go into effect on November 10, 2018, include a number of new regulations that apply in the context of civil settlement negotiations. Attorneys who engage in settlement discussions on behalf of clients should become familiar with their new ethical duties, as noncompliance can lead to discipline by the State Bar. This presentation by JAMS mediator/arbitrator, Phillip Neiman, Esq., will include an overview of the new rules and a discussion of best practices.

 

Discussion topics for this conversation will include:
- Overview of new ethics rules applicable to settlement negotiations
- Rule 4.1: the new duty of candor
- Bluffing, puffing and lying
